Terms and conditions of entry into "Citi & Taronga an eco-friendly summer giveaway 1" Competition

1. The information on how to enter and the prize details form part of these terms and conditions. To the extent that there is any inconsistency between these terms and conditions and any other published material about this competition and this promotion these terms and conditions will prevail. By participating in "Citi & Taronga an eco-friendly summer giveaway 1" competition ("the Promotion"), each participant fully and unconditionally agrees and acknowledges that these terms and conditions are binding.

2. The Promoter is Citigroup Pty Limited ABN 88 004 325 080 AFSL No. 238098 Australian credit licence 238098 of 2 Park Street, Sydney NSW 2000 ("Citi" or "the Promoter"), telephone: 13 24 84. The Promoter and its related bodies corporate (as that term is defined in the Corporations Act 2001 (Cth) will be called "Citigroup" or "Citi".

3. The Promotion opens at 10:00AM AEDT 01 December 2020 and closes at 11:59PM /AEDT 11 December 2020 ("Promotion Period").

4. Entry is open to participants of all ages ("Eligible Entrants"). The directors, management and employees (and their immediate families) of the Promoter, its related entities, printers, suppliers, providers, partners and agencies who are directly associated with the conduct of this promotion are ineligible to enter the Promotion.

5. To enter, Eligible Entrants comment on Citi Australia’s Facebook post at www.facebook.com/citiaustralia/ made at 10:00AM AEDT on 01 December 2020 during the Promotion Period, and submit their best original wildlife image, based on creativity/aptness. An original wildlife image may be a photograph, drawing, painting or artwork created by the entrant ("Eligible Entry").

6. By entering the Promotion Eligible Entrants confirm that their entry is their own original & independent content, and does not infringe the intellectual property rights of any third party. Any entry that contains content that the Promoter, in its sole discretion, considers to be incomplete, inaccurate, underage, erroneous, ineligible, incomprehensible, offensive or inappropriate in any way or that the Promoter considers, in its sole discretion, to infringe any intellectual property rights or other rights of any person, corporation or entity, will be considered ineligible, and may be removed at the Promoter’s sole discretion.

7. There is no limit to the number of Eligible Entries that may be submitted by an Eligible Entrant.

8. All Eligible Entries will be judged by the Judging Panel appointed by the Promoter. This Promotion is a game of skill and chance plays no part in determining the winners. All entries will be Judged individually based on the creative merit or aptness of the image. The best one (1) entry, in the opinion of the Judges, will receive the prize.

9. The Judging will take place at Citigroup, 2 Park Street Sydney NSW 2000 at 10:00am AEDT on Monday 14 December 2020.

10. The winner will be notified on Tuesday 15 December 2020 in the form of a Facebook comment reply to their Eligible Entry. The winner will be announced on the Promotion post on the Citi Australia Facebook page, www.facebook.com/citiaustralia/ from Tuesday 15 December 2020, for a minimum of 28 days. To claim their prize, the winner must respond to the instructions received via Facebook comment. The winner must claim their prize within the time specified in the instructions. The prize will be emailed to the winners, in the form of a voucher

11. In the event that for any reason whatsoever the winner does not claim or accept their prize, the prize will be forfeited by the winner. If a prize is unclaimed by the winner within/by the time specified by the Promoter or the winner selected by the Promoter’s appointed judges is otherwise ineligible to be awarded the prize because they are unable to satisfy these Terms and Conditions, the winner will forfeit the prize, and the Promoter may award the prize to another entrant who the Judges select as the next best entry in the Judging. The subsequent winner must also respond within 24 hours of receiving the direct message from the Promoter’s representative.

12. There is one (1) prize to be won by one (1) individual winner.

13. The winner will win: a one (1) night stay for four (4) people in two (2) bushland rooms at Wildlife Retreat at Taronga, Sydney; Prize includes an afternoon at the Australian native wildlife habitat, three-course dinner at the onsite restaurant, a la carte breakfast, complimentary access to Taronga Zoo for your stay and free parking. (Prize supplier conditions apply).

14. The maximum total prize value is $1,292.

15. The prize is not exchangeable and cannot be taken as cash, unless otherwise agreed by Citi. If the prize (or part of the prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.

16. Costs associated with participating in the Promotion, including but not limited to travel to and from Taronga Zoo Sydney, remain the entrant's responsibility.

17. Bookings cannot be made at the Taronga Retreat during the blackout period between December 24 2020 and January 7 2021.

18. The Promoter is not responsible for and excludes all liability (to the greatest extent allowable by law) for the content of any entries submitted for the purposes of this promotion (including but not limited to any illegal, incorrect or inaccurate content or third party advertising).

19. Each Eligible Entrant is required to enter this Promotion using Facebook, and agrees:

  1. to comply with Facebook’s terms and conditions in relation to promotions, including Facebook’s Statement of Rights and Responsibilities;
  2. that this Promotion is in no way sponsored, endorsed or administered by, or associated with Facebook or any other social media website; and
  3. that any questions, comments or complaints about this promotion must be directed to the Promoter and not to Facebook, or other social media website.

20. The Promoter reserves the right to verify the validity of any and all entries and reserves the right to disqualify any entrant for: (a) submitting an entry which is not in accordance with these terms and conditions; (b) tampering with the entry process; or (c) if the entrant is engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the Promotion. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.

21. Citi maintains the right to feature your entry to the Promotion on the Citi Australia social media pages. By entering the Promotion, Eligible Entrants agree that their name and Eligible Entry may appear on the Citi Australia social media pages for the purpose of promoting the Promotion.

22. Any attempt, deliberate or otherwise, to cause malicious damage to, or interference with, the normal functioning of the promotion, or to otherwise undermine the legitimate operation of the promotion may be a violation of criminal and civil laws and, should such an attempt be made, whether successful or not, the Promoter reserves the right to seek damages to the fullest extent permitted by law. If the Promoter suffers loss or incurs any costs in connection with any breach of these terms and conditions or any other legal obligation by an entrant, the entrant agrees to indemnify the Promoter for those losses, damages and costs on a full indemnity basis.

23. The Promoter and its associated agencies and companies exclude all liability (including negligence) except for any liability that cannot be excluded by law (including any applicable consumer guarantee under the Australian Consumer Law), for any direct or indirect injury, loss and/or damage arising in any way out of the promotion. This includes, but is not limited to: (a) technical malfunctions, delays or failures, including those resulting from accessing any materials related to this promotion and any incorrect, inaccurate or incomplete information communicated in the course of, or in connection with, this promotion as a result of any technical malfunctions, delays or failures; (b) theft, unauthorised access or third party interference; (c) lost or damaged entries, prize claims or prize(s); and/or (d) acceptance and/or use of any prize.

24. If this promotion is not capable of running as planned for any reason beyond the reasonable control of the Promoter, including but not limited to pandemic, war, terrorism, state of emergency or disaster (including natural disaster), infection by computer virus, bugs, tampering, unauthorised intervention, technical failures or anything which corrupts or affects the administration, security, fairness, integrity or proper conduct of this promotion, the Promoter reserves the right, in its sole discretion, to cancel, terminate, modify or suspend the Promotion and/or, if necessary, to provide an alternative prize or prizes to the same value as an original prize or prizes.

25. In these terms and conditions: "Australian Consumer Law" means Schedule 2 of the Competition and Consumer Act 2010 (Cth). "Intellectual Property Rights" means all present and future rights of whatever nature anywhere in the world including, but not limited to, rights in respect of or in connection with copyright, inventions (including patents), trademarks, service marks, trade names, domain names, designs, confidential information, trade secrets and know-how and similar industrial, commercial and intellectual property rights, whether or not registered or registrable, and includes the right to apply for the registration of such rights, and whether existing in Australia.
